User Responsibilities

By using the NotchSkills platform, you agree to take full responsibility for your actions and conduct while interacting with the Platform. As a user, you are expected to adhere to the following guidelines and responsibilities:

As a user of the Platform, you agree to treat other users with respect and fairness. You shall not:

• Engage in any form of discriminatory, abusive, or offensive behavior towards others.

5. Prohibited Activities

You are prohibited from engaging in the following activities while using the Platform:

6. Feedback and Suggestions

If you provide any feedback, suggestions, or ideas to NotchSkills regarding the Platform, you agree that we may use such input without any obligation to compensate you. By submitting feedback, you grant NotchSkills a perpetual, royalty-free, and transferable right to use and incorporate your feedback into the Platform as we see fit.

7. Reporting Violations

If you believe that another user is violating these Terms or engaging in harmful behavior, we encourage you to report it immediately. You can contact us at support@notchskills.com to report any suspicious or inappropriate activity.

8. Consequences of Violation

If you fail to comply with these responsibilities or violate any part of this Agreement, NotchSkills reserves the right to suspend or terminate your access to the Platform, remove your content, or take other appropriate actions without prior notice. Violations may also result in legal action, if necessary, to protect the Platform and its users.

Prohibited Activities

To maintain a safe, respectful, and lawful environment for all users, the following activities are strictly prohibited on the NotchSkills platform. Engaging in any of these activities may result in immediate suspension or termination of your account, as well as potential legal consequences:

1. Unauthorized Access or Interference

You may not attempt to gain unauthorized access to any part of the platform, including user accounts, systems, or networks connected to the platform. This includes:

• Hacking or attempting to hack into the platform’s systems or any associated servers or accounts.
• Attempting to disrupt, disable, or interfere with the proper functioning of the platform, including through methods such as denial-of-service (DoS) attacks.
• Accessing or attempting to access content, materials, or features of the platform that are not intended for your use.

2. Misuse of Account Information

You are prohibited from using someone else's account or providing false information in your account profile. This includes:

• Impersonating another person, company, or entity to gain unauthorized access to the platform.
• Using fake, misleading, or incorrect personal details during registration or communication.
• Sharing your account details with unauthorized third parties.

3. Distribution of Harmful Content

Users must not upload, post, or share content that could harm the platform or its users, including, but not limited to:

• Viruses, worms, malware, or other harmful code that may interfere with the normal functioning of the platform or compromise the security of users’ devices.
• Content that promotes or engages in illegal activities, including but not limited to fraud, piracy, or hacking.
• Defamatory, offensive, or discriminatory content that could harm or harass others, including hate speech, violence, or explicit material.

4. Engaging in Fraudulent Activities

Any fraudulent activity on the platform is strictly prohibited, including:

• Creating fake accounts or misleading content to deceive other users or NotchSkills.
• Attempting to manipulate or exploit platform features for financial gain without proper authorization.
• Using the platform for money laundering, deceptive marketing, or other illicit financial activities.

5. Violating Intellectual Property Rights

You must not infringe upon the intellectual property rights of others, including:

• Copying, distributing, or using content (e.g., videos, images, text) from the platform without permission or the appropriate licensing rights.
• Using trademarks, logos, or copyrighted materials without authorization from the rightful owner.

6. Spamming and Unsolicited Communications

You are prohibited from engaging in spam or sending unsolicited communications, including:

8. Exploiting Vulnerabilities

You are prohibited from exploiting any vulnerabilities in the platform’s software or systems for personal gain or malicious purposes. This includes:

• Attempting to reverse-engineer or decompile the platform’s code.
• Engaging in any activity that compromises the integrity of the platform’s software or systems.

9. Selling or Transferring Accounts

Users are prohibited from selling, transferring, or allowing others to use their account without express permission from NotchSkills. This includes:

• Attempting to sell your account, course access, or other platform privileges to other users.
• Allowing third parties to access your account in exchange for compensation or other benefits.

10. Unlawful Conduct

You must not engage in any conduct that is unlawful or violates the rights of others, including:

• Engaging in illegal activities such as drug trafficking, fraud, or terrorism.
• Using the platform to promote or engage in any form of illegal trade or activity.

11. Other Prohibited Activities

Any other activity that NotchSkills deems as harmful to the platform, its users, or its reputation is prohibited. We reserve the right to take action against users engaging in activities that disrupt the platform's services or violate its mission and policies.

Content Ownership

By uploading, submitting, or otherwise providing content (including but not limited to text, images, videos, audio, and other materials) to the NotchSkills platform, you agree to the following terms regarding content ownership:

1. Ownership of User-Generated Content

As the user, you retain full ownership of any content that you upload or submit to the platform, provided that:

• You have the necessary rights, permissions, or licenses to use and upload the content.
• Your content does not violate any intellectual property rights, trademarks, or copyrights of third parties.

You are solely responsible for the content you upload, including any legal liabilities or claims that may arise from the use or distribution of such content.

2. License to NotchSkills

By uploading content to NotchSkills, you grant NotchSkills a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to:

• Use, display, distribute, modify, adapt, publicly perform, and publish your content solely for the purposes of operating and improving the platform.
• Promote and market the content through NotchSkills’ official channels, including but not limited to the platform's website, social media pages, and other promotional material.

This license is granted for the duration of the content's presence on the platform and is necessary for the platform to function and deliver the services you have agreed to.

3. Platform Content Ownership

NotchSkills retains full ownership of all content that is created, developed, or provided by NotchSkills, including the platform's code, design, graphics, logos, trademarks, and other proprietary content. Users do not have ownership rights to this content, and it is protected by copyright and intellectual property laws.

4. User Content Removal

You may delete your uploaded content from the platform at any time. However, by deleting your content, you acknowledge that cached or archived versions of the content may still exist on the platform or third-party services. NotchSkills is not responsible for retaining copies of content once it has been deleted, and there is no obligation to restore or republish removed content.

5. Responsibility for Content

While NotchSkills respects the ownership rights of users, we reserve the right to remove or modify any content that violates our Terms of Service, community guidelines, or applicable laws. If your content is found to be infringing on the intellectual property rights of others, NotchSkills may remove it from the platform, and your account may be subject to termination.

Termination of your account does not relieve you of your obligation to pay any outstanding fees or charges that are owed at the time of termination.

You may terminate your account at any time by contacting NotchSkills support and requesting account deletion. However, please note that termination of your account does not absolve you of any responsibilities or obligations incurred prior to the account termination.

4. Post-Termination Rights

Even after the termination of your account, certain provisions of these Terms of Service may still apply, including but not limited to provisions related to intellectual property, disclaimers, limitations of liability, and indemnification.

5. Survival of Terms

The provisions of these Terms of Service that, by their nature, should survive termination (such as those relating to ownership, indemnification, and liability) will continue to remain in effect after your account is terminated.
